Selling Your Home

What is a listing agreement and what should it include?

By Bob Millaway July 26, 2026

Short Answer

A listing agreement is a contract between you and your real estate agent authorizing them to market and sell your home. It should include the listing price, the commission rate, the length of the agreement (typically three to six months), the scope of services the agent will provide, and any exclusions or special terms. Read it carefully before signing and ask questions about anything you do not understand.

A listing agreement is a legally binding contract that defines the relationship between you and your agent. The most common type is an Exclusive Right to Sell listing, which means the agent earns a commission if the home sells during the agreement period, regardless of who finds the buyer. The agreement should specify the listing price, the commission rate (typically 5% to 6% total, split between the listing and buyer's agent), and the duration of the agreement. It should also outline the services the agent will provide, including marketing, photography, showings, open houses, and negotiation. The agreement may include a safety clause, which extends the commission obligation for a period after the agreement ends if the home is sold to a buyer who was introduced during the listing period. Review the termination clause, which explains how you can cancel the agreement if you are not satisfied. Ask your agent to explain every term before you sign. I provide a clear, detailed listing agreement and walk through every provision with my clients so there are no surprises.

Your listing agreement is the foundation of our working relationship. I want you to feel completely comfortable with it before you sign. I will explain every clause, answer every question, and make sure you understand exactly what you are agreeing to. A good listing agreement protects both of us and sets clear expectations. If anything feels unclear, I want you to ask. That is how we build trust from the start.
