Selling Your Home

What should I disclose about previous renovations or repairs?

By Bob Millaway July 26, 2026

Short Answer

In New Jersey, you must disclose any known material defects, including past renovations or repairs. If you had work done, disclose what was done, who did it, and whether permits were obtained. If you are unsure whether permits were required, disclose that as well. It is better to over-disclose than to risk a lawsuit later. Buyers will discover issues during their inspection, and undisclosed problems can lead to legal liability after the sale.

New Jersey law requires sellers to disclose known material defects that affect the property's value or safety. This includes renovations and repairs. If you added a room, replaced the roof, updated the electrical, or installed new plumbing, you should disclose that work. If the work was done with permits and passed inspections, provide copies of the permits and inspection sign-offs. If the work was done without permits, disclose that too. The buyer may ask for permits to be obtained after the sale, or they may accept the work as-is. If you are unsure whether a past repair needs to be disclosed, err on the side of disclosure. A buyer who discovers undisclosed issues after closing may have legal recourse, including suing for damages or demanding that you fix the problem. Your agent will help you complete the Seller's Property Disclosure Statement accurately. If you have documentation of past work, organize it and make it available to the buyer. Transparency builds trust and helps the transaction close smoothly.
