What is the difference between a real estate agent and a broker?

A real estate agent is licensed to represent buyers and sellers in real estate transactions, but they must work under the supervision of a licensed broker. A broker has completed additional education and licensing requirements, allowing them to work independently and manage their own brokerage. Brokers can hire agents, open their own offices, and are responsible for ensuring all transactions comply with the law. In New Jersey, agents are called salespersons, and brokers hold a broker license.

The primary difference between an agent and a broker is the level of education, experience, and responsibility. In New Jersey, a real estate salesperson (agent) must complete 75 hours of pre-licensing education, pass the state exam, and work under a licensed broker. A broker must complete additional education, typically 150 more hours, have at least two years of experience as a salesperson, pass a more advanced exam, and meet other requirements. Brokers can own and operate their own real estate firms, hire agents, and are responsible for ensuring all transactions comply with state and federal laws. Brokers also handle trust accounts, supervise agents, and are ultimately responsible for the conduct of the agents who work for them. When you work with an agent, you are actually working with the broker's company. The broker is the person legally responsible for the transaction. Both agents and brokers can provide excellent service, but the broker carries more responsibility and authority.
